Abstract
Bu kısa incelememizde, taşımacılık sektöründe sorun çıkaran “sefer primi “ kavramı üzerinde durmaya ve sadece seferde kullanılmak için verilen bu primin ücret sayılıp sayılmayacağı konusunda ,iş sözleşmesi tarafları arasında oluşabilecek uyuşmazlıklara ve bu konuda verilmiş önemli bir Yargıtay kararındaki prensipleri incelemeye çalıştım. Her ne kadar iş hukukunun temel ilkesi,” işçinin korunması’’ ise de, bu ilkenin sosyal barışı tehlikeye düşürecek şekilde genişletilmemesi gerektiği kanısındayım.
In cases where the employer and the employee do not give the same meaning to a payment and an application, it is possible that the peace of labor will be deteriorated. In this short study of ours, I tried to focus on the concept of “travel premium“, a concept which causes problems in the sector of transportation and to examine the potential disputes between the parties of the contract of employment on whether this premium would be accounted as a wage or not and to examine the principles in a major Supreme Court decision made on this subject. Although the basic principle of labor law is to “protect the employee”, I believe that this principle should not be extended in a manner to jeopardize social peace.
