dc.description.abstractDüşünceyi açıklama özgürlüğü, özgürlükçü bir demokratik düzen için kurucu öğedir. Çünkü düşünsel tartışmayı ve kendi varlık nedeni olan düşüncelerin savaşını olanaklı kılar. Düşüncenin serbestçe oluşumu bir yandan “düşünceleri serbestçe açıklamak ve yaymak özgürlüğünü”, diğer yandan açıklanan “düşüncelerden haberdar olmayı ve bilgi edinmeyi” şart koşar. Demokratik bir anayasal sistemde enformasyon özgürlüğü serbestçe kamusal düşünce oluşumunun koşulu olması nedeniyle, düşünceyi açıklama ve yayma özgürlüğünden daha aşağı bir basamağa yerleştirilmemelidir. Klasik temel haklarla korunan değerleri belki de aştığı için, internet özgürlüğünü kendine özgü, yeni bir temel hak olarak düşünmek ve düzenlemek gerekir. İnternet özgürlüğünde, internet vasıtasıyla telekomünikasyon özgürlüğü söz konusudur. Bu özgürlük, verileri, enformasyonları ve düşünceleri yayarak iletmeği ve almayı kapsar.en_US
dc.description.abstractFreedom of expression is the costituent element of a democracy since it brings in its train intellectual debate and the contention of ideas, i.e. democracy’s own raison d’etre. The free formation of thought stipulates on the one hand “the free expression and dissemination of ideas” and on the other, “having access to and taking cognizance of ideas”. Since in a demo-cratical constitutional system freedom of information is the condition of the free formation of public opinion, it should not be underestimated and considered below “the free expression and dissemination of ideas”. Free expression on the internet should be considered as a specific fundamental right and organized accordingly since it is beyond the classical fundamental rights. Freedom of expres-sion on the internet means freedom of telecommunications through the medium of the internet. This freedom inheres in it the communication and reception of data, information and ideas.en_US
