dc.description.abstractÇocuk haklarına açıkça Anayasada yer verilmesi, onların toplumumuzun eşit haklara sahip bireyleri olarak değerlendirildiğinin ifadesidir. Çocuklara kendilerine özgü önemli temel hakları garantileyen bir Anayasa onların, devletin ve toplumun gelecekteki taşıyıcıları oldukları bilincini açığa vurmaktadır. Bu aynı zamanda, çocukların haklarının korunması konusundaki toplumsal bilincin sağlamlaştırılmasına da elverişlidir. Böylece çocuğun durumu, hem devlet, hem bir uyuşmazlık durumunda anne baba karşısında güçlenecek ve kararlar bugüne kadar olduğundan daha fazla çocuğun mutluluğuna yönlendirilmiş olacaktır. Türkiye’nin de toplumun mutluluğu için çocuk haklarını Anayasa hukuksal açıdan ne kadar yüksek bir basamakta değerlendirdiği uluslararası boyutta belgelendirilmiş olacaktır. Tarafı olduğumuz Çocuk Hakları Sözleşmesi’nin beklentilerini Anayasamız karşılamamaktadır. Çocuğun temel hak taşıyıcısı ve hukuk süjesi olduğu, yani bağımsız bir kişilik olarak tanınması Anayasada dile getirilmemiştir.en_US
dc.description.abstractStating Children’s Rights in The Constitution clearly means that children are regarded as individuals with equal rights in our society. A Constitution securing important basic rights for children openly declares the consciousness that children are the carriers of the society and the state to the future. This fact also helps reinforce the social consciousness about protecting children’s rights. Thus the child’s position is strengthened in front of both the state and parental authority in case of a disagreement or complaint and the court decisions will be directed more towards the happiness of the child than it has been the case today. Thus, for the happiness of society, a higher evaluation of children’s rights in the Turkish Constitutional legislation will be documented regarding the international community. At the moment our Constitution does not cover the expectations of Children’s Rights Agreement to which we adhere. The fact that a child is the bearer of basic rights and is the subject of law, that he/she is an independent entity is not mentioned in the Constitution.en_US
