dc.description.abstractUluslararası ticaret, herhangi bir iş anlaşmasında olduğu gibi son derece riskli bir girişimdir. Ticaret riskleri doğru ve düzgün bir sigorta temin etmek suretiyle asgariye indirilebilir. Ticari eşya veya emtea, ticaretin konusudur. Hemen hemen her şey, emtea sigortasının konusu olabilir. Dış ticaret işlemleri, hem emtea sigortası ve bunun kimin sorumluluğunda olacağı hususunu kapsar. Bu sorumluluk, ihracatçı ve ithalatçı arasında paylaşılabilir ya da sadece tek birisi tarafından üstlenilir. Bu şekilde bir sigorta sorumluluğunun paylaştırılması, dış ticaret sözleşmesinde de kayıt altına alınması gerekir. Taraf sözleşmede sigorta sorumluluğunu açıkça paylaşımı açık bir şekilde düzenlememişler ise, bu takdirde, uluslararası emtea satışlarına dair faaliyetlerde geçerli teamüller gereğince kabul edilen şartlardan faydalanılabilir. Uluslararası emtea satışlarına dair faaliyetlere konu en eski sigorta türü, emtea sigortası (Deniz Emtea Sigortaları) dır. Bu çerçevede, işbu çalışmada, özellikle deniz emtia sigortaları bakımından (yeri geldikçe diğer taşıma türlerine dair mal sigortalarına da değinilmek suretiyle) uluslararası satışlarda emtia sigortasının hukuki açıdan önemli yönlerinin ortaya konulması amaçlanmıştır.en_US
dc.description.abstractInternational trade is a risky venture as any business deal. The risks of commerce can be minimized by being properly insured. The merchandises or goods are the things of trade. Almost everything can be the subject matter of the cargo policy. The insurance of foreign trade operations includes the property insurance and the insurance of liability. The responsibility part can be divided between the exporter and the importer or carried out by the one side only. Such apportionment of liability must be registered in the foreign trade contract. If the sides do not determine the clear distribution of insurance duties in the contract, they can take advantage of the terms accepted in the practice of the international sale of goods. The oldest type of insurance, which accompanies the practice of the international sale of goods, is the insurance of cargo (Marine Insurance). In this context, this study is aimed to review and determine the key legal aspects of the cargo insurance on the international sales, in particular from the marine cargo insurance’s aspect (and time to time by addresing the cargo insurances for the other transportation type).en_US
