Özet
Denizde çatma hukuku, müşterek avarya kurumunun tarihsel gelişimine nazaran oldukça yeni bir müessesedir. Ancak buna rağmen çatma hukuku uluslararası alanda hızlı bir gelişim göstermiştir. Uluslararası alanda birleştirme çalışmaları Çatma ile İlgili Bazı Kuralların Birleştirilmesi Hakkındaki 23.9.1910 tarihli Brüksel Konvansiyonu, Çatma Konusunda Hukuki Yetki İle İlgili Bazı Kuralların Birleştirilmesi Hakkındaki 10 Mayıs 1952 tarihli Brüksel Konvansiyonu ve Denizde Çatmayı Önleme Uluslararası Kuralları ile sağlanmaya çalışılmıştır. Bunların dışında, çalışmamızda Türkçe çevirisi yapılan 1987 Lizbon Kuralları çatmadan doğan tazminat taleplerinde, talep sahibinin zıya ve zararının tespiti ve takdirine ilişkin kurallara yer verilmektedir. 1987 Lizbon Kuralları, York Anvers Kuralları gibi bir konvansiyon niteliğinde olmayıp, ilgililerin sözleşmelere veya konişmentolara bir şart olarak konulmaları tavsiye edilen kurallardır ve uygulanması isteğe bağlıdır.
The Law concerning collision at sea is a relatively new institution, rather than the general average law, which has a long history. However, despite emerging recently, collision law has shown rapid progress in the field of international law. In the international arena, studies of the unification of rules are known as International Convention for the Unification of Certain Rules of Law with Respect to Collision between Vessels, dated 23.9.1910, International Convention on Certain Rules Concerning Civil Jurisdiction in Matters of Collision dated 10.05.1952, Convention on the International Regulations for Preventing Collisions at Sea, 1972 (COLREG). Other than these, 1987 Lisbon Rules which has been translated into Turkish in this study, are available for adoption in cases where damages are claimed following a collision and apply to the assessment of the loss and damages. The 1987 Lisbon Rules, like York Antwerp Rules, are not in the nature of a convention and can be used as a part of contracts or a bill of landings. It is optional to use these Rules or not.
