| dc.description.abstract | Sigorta sözleşmesi her iki tarafa borç yükleyen ve sürekli bir borç ilişkisi doğuran sözleşme niteliğindedir. Dolayısıyla, sigorta ettiren sigorta himayesini ancak bazı yükümlülüklerini yerine getirmek suretiyle sahip olabilir. Sigorta ettirenin kanun, sigorta genel şartları ve sigorta sözleşmesinden doğan bu yükümlülükleri hukuk niteliği itibariyle borç ve görev mahiyetindedir. Sigorta ettirenin prim ödeme yükümlülüğü borç, sigorta ettirenin kanun veya sözleşme ile yüklenmiş olan ihbar ve davranış yükümlülükleri ise, görev mahiyetindedir. Çalışmamızda, bu genel ayırım kapsamında Yeni Türk Ticaret Kanunu uyarınca sigorta sözleşmesi süresi içerisinde sigorta ettirenin yükümlülükleri incelenmektedir. | en_US |
| dc.description.abstract | The insurance contract is a synallagmatic contract and leads to a continuous relationship between the insured and the insurer for a specific period. Therefore, to be under the insurance coverage the insured has to fullfill some liabilities. The liabilities of the insured, which arise from law, insurance general conditions and insurance contract, are considered obligations and duties. The payment of the premium by the insured is an obligation; notification and behavioural liabilities are duties of the insured. The purpose of this paper is to provide a general review of the obligations and duties of the insured during the insurance contract under the New Turkish Commercial Code. | en_US |
