dc.description.abstractKira sözleşmeleri; bir eşyadan yararlanılması ve eşyanın kullanılmasına ilişkin hakkın, bir ücret karşılığı, belirli ya da belirli olmayan bir süre zarfında başka birine devredildiği sözleşmelerdir. Türk Borçlar Kanunu’nun 300. maddesinin II. fıkrasında, “belirli süreli” kira sözleşmelerinin dışında kalan diğer tüm kira sözleşme çeşitlerine yönelik “belirsiz süreli” hükmü yer almaktadır. Belirli süreli kira sözleşmelerinde, taraflarca belirlenmiş belirli bir süre sonunda tarafların ayrı bir irade göstermesi gerekmeksizin sözleşme kendiliğinden sona erebilirken, sürenin belirsiz olduğu yani sözleşme konusu ilişkinin taraflarca sözleşmede belirlenmemiş olduğu durumlarda kurulan ilişkinin kendiliğinden sonlanması mümkün olamamaktadır. Bu durum da belirsiz süreli sözleşmelerde kurulan ilişkinin sona ermesine yönelik bir eksiklik doğurmaktadır. Bu eksikliği gidermek amacıyla Türk Borçlar Kanunu’nda farklı ilişki konularındaki sözleşmelere yönelik taraflara bir olağan fesih hakkı sunulmuş, bu fesih hakkı da belirli bir süre sonunda sözleşmeyi sona erdirme özelliği olan bir feshi ihbar koşuluna bağlanmıştır. Makalemiz konut ve çatılı işyerlerinde feshi ihbar konusunu, süresine göre (belirli ve belirsiz süreli) ve sebebin kaynağı olan tarafa göre (kiracı ve kiraya veren) feshi ihbarı özelinde yoğunlaşacaktır. en_US
dc.description.abstractLease agreements are the contracts in which the right to use and utilization of a thing is transferred to another person for a fee, for a certain (definite) or non-specific period (indefinite). Article 300/II of Turkish Code of Obligations (TCO), accepts all other types of lease contracts other than definite term (fixed-term) agreements as indefinite term contracts. In definite term lease contracts, the contract may automatically terminate at the end of a certain period determined by the parties, but the relationship cannot be terminated spontaneously in cases where the term is indefinite, i.e. the contractual relationship is not determined by the parties in the contract. This situation leads to a deficiency in the termination of the relationship established in indefinite term contracts. In order to remedy this deficiency, in the TCO, the parties are provided with the right to terminate the contract for different relationship matters and this right of termination is subject to a notice of termination which is capable of terminating the contract after a certain period of time. In this study, the subject of termination notice in residential and roofed workplaces has been examined as termination notice according to the period (definite and indefinite term) and as termination notice according to the source of the cause (the lessee and the lessor).en_US
