Özet
Demokrasi, öncelikle her vatandaşın, temel siyasal organların kuruluşuna katılma konusunda eşit ve serbest şansa sahip olmasını sağlayan, kendisini devamlı yenileyen ve demokratik düşünce ve irade oluşumunu açık tutan hukuksal kurallarla var olabilir. Demokrasi, erkler ayrımının varlığına bağlı olan temel hakları şart koşar. Temel haklara ve anayasal bir düzenlemeye duyduğu bu gereksinme nedeniyle demokrasi, demokratik anayasal devletin temelini oluşturamaz. Tersine demokrasi hukuken bağlayıcı bir Anayasanın varlığına bağlıdır. İnsan onurundan kaynaklanan özgürlük ve eşitlik, klasik-batı demokrasisinin temelini oluşturmaktadır.
Democracy can exist primarily with legal rules that ensure that every citizen has an equal and free chance to participate in the establishment of basic political organs, that constantly renews itself and that keeps the formation of democratic thought and will open. Democracy stipulates fundamental rights that depend on the existence of separation of powers. Because of this need for fundamental rights and a constitutional arrangement, democracy cannot form the basis of a democratic constitutional state. But rather democracy depends on the existence of a legally binding constitution. Freedom and equality stemming from human dignity form the basis of classicalwestern democracy.
