Özet
6502 sayılı yeni Tüketicinin Korunması Hakkında Kanun madde 7 ile 6098 sayılı yeni Borçlar Kanunu madde 7'de düzenlenen ısmarlanmayan/sipariş edilmeyen şeyin/malın gönderilmesi ve sipariş edilmeyen hizmetin sunulması her iki kanun açısından yeni bir madde olduğundan, makalede her iki madde hem incelenecek hem de aralarındaki benzerlik ve farklılıklara değinilerek hukuki nitelendirmeleri yapılmaya çalışılacaktır.
The regulations in the article 7 of the Law on Protection of the Consumer with number 6502 and the article 7 of the new Law of Debts with number 6098 regarding the delivery of unsolicited good and the offer of unsolicited services are both new issues in these laws, both articles are going to be explored in this paper and the similarities and differences between them are emphasized and described with respect to the discipline of law.
