| dc.description.abstract | Vasiyetname ile miras sözleşmesi arasında bunları yapabilme ehliyeti ve muhtevaları açısından bazı farklılıklar mevcut olsa da bu iki ölüme bağlı tasarruf arasındaki en önemli fark, miras bırakanın vasiyetnameden istediği zaman tek taraflı olarak geri dönebilmesi mümkün olduğu halde, miras sözleşmesinden istediği zaman geri dönememesidir. Ancak, miras bırakanın miras sözleşmesinden istediği zaman geri dönememesi kural olmakla beraber, bazı durumlarda miras sözleşmesinden tek taraflı irade beyanı ile dönmesi mümkün olmaktadır. Bu çalışmamızın konusunu da bu hususlar oluşturmaktadır. | en_US |
| dc.description.abstract | Although there are some differences between the contents of testament and heritage contract and the capacity of making those, the main difference between these two testamentary dispositions is that though the deceased person can recede from the testament whenever he likes he cannot recede from the heritage contract whenever he wants to do so. Even if the deceased person, as a rule, cannot recede from the heritage contract whenever he likes, under some circumstances it is possible for him to recede by his unilateral declaration of intent. The subject of this study is composed of these issues. | en_US |
