Özet
Bu çalışmanın ana konusunu, “85/374 sayılı Ayıplı Ürün Nedeniyle Sorumluluk Hakkında Üye Ülkelerin Hukuki ve İdari Düzenlemelerinin Birbirine Yakınlaştırılması Hakkında Yönerge” ve “Ayıplı Malın Neden Olduğu Zararlardan Sorumluluk Hakkında Yönetmelik” hükümlerine göre, üreticinin sorumlu olduğu ayıp kavramı oluşturmaktadır. Ayıp kavramının daha iyi anlaşılması için, söz konusu Yönerge ve Yönetmeliğin amaç ve kapsamı da çalışmamızda kısaca incelenmiştir.
The main subject of this study is the term of defective that the producter is responsible, according to “Council Directive for the approximation of the laws, regulations and administrative provisions of the Member States concerning liability for defective products, no: 85/374” and “Regulations about the damages caused by defective products”. In the study are discussed briefly the purpose and scope of the Directive and Regulation for a better understanding of the term of defective.
