Özet
York Anvers Kuralları, revizyon çalışmaları CMI müşterek avarya Uluslararası Çalışma Grubu tarafından yürütülmekte olup, nihai metnin CMI’ın 2016 yılında New York Kon-feransı’nda sunulacağı öngörülmektedir. Bu çalışmanın amacı, CMI müşterek avarya Uluslararası Çalışma Grubu’nun York Anvers Kuralları 2016‘ya ilişkin olarak taslak metin hazırlıklarının değerlendirilmesi sırasında Türk Hukuku da dahil olmak üzere denizci ülkeler ve yasal düzenlemelerinin tarihsel süreç ve kapsamının genel hatlarıyla tespit edilmesi hedeflenmiştir.
Revisions of the York Antwerp Rules are conducted by CMI International Working Group and the final draft will be presented at the New York Conference of CMI which will be held in May 2016. The purpose of this study was to evaluate how general average concepts have developed and been implemented across maritime countries and jurisdictions. In addition, the historical record of maritime nations and their regulations was addressed to determine the scope of the legislation by including Turkish law.
