| dc.description.abstract | Aktif statü, bireyin özgürlüğünü, devlet içinde ve devlet için kullandığı durumdur. Vatandaşlık hakları ile biçimlenir ve güvence altına alınır. Demokratik devlet vatandaşı, sadece aktif statüde değil, negatif statüde de, gazete okuyucusu, yayımcı, dernek ve parti mensubu olarak, toplantı ve gösterilerde düşünceleri ile demokratik devlete katkıda bulunup onu şekillendirebildiğinden, negatif statünün temel haklarında da yorum sırasında, devletle olan demokratik fonksiyon ilişkisi göz önünde tutulmalıdır. Temel haklar, özgürlükçü demokratik düzenin temel öğeleridirler. Onlar sayesinde devlet, vatandaşlarının büyük bir çoğunluğu tarafından onaylanmaktadır. Böylece temel haklar bireyin, devletten yana kısmen bağımlılıktan kurtulması ve devlet karşısında garantisi ile sınırlı kalmayıp, devlete bağlayıcı bir bağ, siyasal anlaşmanın temeli olarak görülmelidir. | en_US |
| dc.description.abstract | Status Activus, is the status of a person using his/her freedom inside the state and for the state. It is formed by and guaranteed under citizenship rights. The citizen of a Democratic State, not only in status activus but also in status negativus, since he/she with his/her thoughts could contribute towards and thus form the Democratic State in meetings and demos either as a newspaper reader, a publisher, or a member of a party or an organisation, in the fundamental rights of the negative status his/her democratic functional relationship with the State should be taken into consideration. Fundamental Rights are the basic items of the libertarian democratic system. The State is approved by the majority of its citizens under the favour of Fundamental Rights.As such fundamental rights are not only limited to the individual’s being semiindependent and guaranteed against the State but also they should be considered as a binding contract to the State and as the foundation of political consensus. | |
