Abstract
Ticari faaliyetlerin küreselleşmesi ve bilişim teknolojilerinin gelişmesi ile birlikte artık taraflar hukuki ilişkilerini geleneksel yöntemler dışında daha hızlı bir biçimde uzaktan da kurmaya başlamışlardır. Özellikle internetin ortaya çıkışı ve yaygınlaşması, internetin ticari faaliyetler açısından önemli bir araç haline gelmesi ile elektronik ortamda kurulan hukuki ilişkilerin niceliği artmış ve mahiyeti çeşitlenmiştir. İnternet teknolojisi sayesinde ülkeler ve hatta kıtalar arası sözleşmelerin kurulması anlık olarak gerçekleşebilmektedir. Bu nedenle elektronik ortamda kurulan ve yabancılık unsuru taşıyan bu borç ilişkileri nedeniyle uyuşmazlıklar ortaya çıkmış ve uygulanacak hukukun tespiti de karmaşıklaşmıştır. Bu sebeplerden dolayı elektronik ortamda doğan borç ilişkilerine uygulanacak hukukun tespiti konusu bu makalede detaylı olarak incelenmektedir
With the globalization of commercial activities, the parties have started to establish their legal relations by methods other than establishing them face to face. Especially, the use of the Internet in terms of commercial activities and the emergence of legal relations with the electronic environment began to be established and its nature became diversified. With the internet technology, the establishment of contracts between countries and even continents can be realized instantly. Disputes arose because of these debt relations established in electronic environment and the determination of the law to be applied is complicated. Because of these reasons, determination of the law to be applied to the debt relations arising in the electronic environment has been examined with details in this Article.
