Özet
Anayasa md. 41 kurumsal bir garanti içermektedir. Bu kuralla evlilik ve aile Türk hukuk düzeninin özgün birer kuruluşu olarak garanti altına alınmışlardır. Anayasa md. 41 kuralı, evlilik ve ailenin kendine özgü alanını korumak için klasik bir temel hak, kurumsal bir garanti ve aynı zamanda tüm aile ve evlilik alanlarını ilgilendiren özel ve kamu hukuku için bağlayıcı bir değer yargısı içermektedir. Devletin evlilik ve aileyi koruma görevinden, yasa koyucu için evlilik ve aileye herhangi bir yasa normu ile zarar verme yasağı ile, evlilik ve aileyi özendirme ve destekleme emri çıkmaktadır.
Article 41 of constitution includes an institutional warranty. By this rule marriage and family are guarenteed as an original institution of Turkish Law System. Article 41 of Constitution includes a classical fundamental right, institutional warranty and also binding value judgement for private and public law concerning whole family and marriage areas to protect areas specific to marriage and family. The fact that the legislator is prohibited to harm the family by a law norm and instructed to promote and support the family arises from the duty of state regarding protection of family and marriage.
