Özet
Gelişen teknolojiye bağlı olarak ortaya çıkan bazı risklerin varlığı bilimsel çalışmalar açısından tartışmalıdır. Bilimsel açıdan varlığı ve yokluğu hakkında kesin bir karara varılamayan bu tür risklere, hayalet riskler denmektedir. Bilim çevrelerince varlığı hususunda uzlaşma sağlanamayan bu riskler, hukuk açısından da zorluk yaratır niteliktedir. Mahkemeler, bir hayalet riskin zarara yol açtığı iddiasıyla açılan bir davada, bu risk ile zarar arasında nedensellik bağını kurmadan sorumluluk uygulayamayacağı için eldeki çalışmaları çok dikkatli değerlendirmek durumundadır. Zira bir hayalet riskin niceliksel olarak vereceği zararın yanında bu riskin niteliksel özellikleri de toplum açısından ciddi endişelere sebebiyet vermektedir.
Phantom risk is a risk that cause and effect relations is unproven. There is a great disparity between the suspected hazard and a health effect. Tort law approaches the issue of risk differently than does science.It is necessary for the plaintiff to a tort action to prove a legally and factually cognizable connection between the risk presumed and injured suffered. Probabilistic evidence provides the court with evidence of risk developing a certain illness as a result of that risk. In addition, the public perceives phantom risks are dangerous. Hence judges should be more careful in appraising scientific evidence and evaluating risk researh.
