dc.description.abstractBireyin, hukuk düzeni tarafından korunan kişilik hakkına karşı hukuka aykırı olarak yapılan bir saldırı sonucunda ikame edeceği manevi tazminat davasında görevli ve yetkili mahkemeyi doğru tespit etmesi gerekir. Aksi halde görevsiz mahkemede ikame edilen dava, dava şartı yokluğundan; yetkisiz mahkemede açılan dava ise yetki ilk itirazı nedeni ile usulden reddedilebilir. Bu nedenle çalışmamızda manevi tazminat davasında görevli ve yetkili mahkemenin tespiti sorununu, HMK ve MK hükümlerini nazara alarak incelemeyi amaçlıyoruz. en_US
dc.description.abstractAn individual would have to make an accurate detection of the authorized and jurisdiction court on the substitution of the lawsuit for mental anguish, as a result of an unlawful attack against his personal rights protected by the rule of law. Otherwise, the case which is substitute unauthorized court could be rejected because of the absence of the cause of action, while the lawsuit brought on the jurisdiction court being rejected from the rule due to the first plea of jurisdiction. Therefore, in our study, we aim to consider the results of accurate detection of the authorized and jurisdiction court on the lawsuit for mental anguish by taking the Procedural Law Code and Civil Code clauses into account.
