dc.description.abstract6102 sayılı Türk Ticaret Kanunu'nun 37. maddesi, Türk Hukuku'nda ilk kez ticaret sicilinde hukukî görünüşe güven konusunu düzenlemektedir. Anılan norm uyarınca, ticaret sicilindeki kayıt ile ilân edilen durum arasında aykırılık bulunması hâlinde, tescil edilmiş olan gerçek durumu bildikleri ispat edilmediği sürece, üçüncü kişilerin ilân edilen duruma güvenleri korunur. Bu çalışmada, ticaret sicilinde hukukî görünüşe güven konusunu düzenleyen TTK'nun 37. maddesinin öngörülme amacı, uygulanma alanı, uygulanma koşulları ve hukukî sonuçları üzerinde durulacaktır. en_US
dc.description.abstractArt. 37 of Turkish Commercial Code no. 6102 is regulating the trust in the legal appearance. Regarding to the mentioned norm, in case of a difference between the registered content and the published status, third parties trust in the published status will be protected, unless it is proved that such third party has known the real situation.In this study, the enactment purpose, the application area, the application conditions and legal consequences of Art. 37 of TCC, which regulates the trust in the correctness of the registered content, will be discussed.
