Abstract
Her iki tarafa borç yükleyen ve sürekli bir borç ilişkisi doğuran sigorta sözleşmelerinde, sigorta ettirenin sigorta himayesinden yararlanabilmesi ve sigortacının sorumluluğunun başlayabilmesi (taşıma sigortaları dışında) için, sigorta ettirenin prim ödeme yükümlülüğünü yerine getirmesi gerekmektedir. Bu bakımdan primin ödenmesi gerek sigorta himayesinin başlaması gerekse sözleşmenin devamı açısından önemlidir. Bu önemi dolayısıyla, sigorta ettirenin prim ödeme borcunda temerrüde düşmesinin sonuçları, temerrüdün Türk Borçlar Kanunu’na özgü genel sonuçlarından ayrı ve farklı olarak Türk Ticaret Kanunu md.1434’te düzenlenmiştir. Bu çalışmada, sigorta ettirenin sigorta prim borcunu ödememesinin hukuki sonuçları incelenmiştir.
In the case of insurance contracts those burden both parties with debts and give rise to a permanent debt relationship, the policyholder must fulfill the obligation to pay the Premium in order for the policyholder to benefit from the insurance coverage and to start the responsibility (except for transportation insurances) of the insurer. In this respect, the payment of the premium is important both for the start of insurance protection and for the continuation of the contract. In consideration of this importance, the results of the default of the policyholder in debt payment is different from the general results of the default on the Turkish Code of Obligations and disparately it is regulated under the Turkish Commercial Code Article 1434. In this study, the legal consequences of the insurant’s non-payment of insurance premium debt are examined.
