Özet
Bilim, bilimsel araştırmalar ve yayınlarla insanlığa yön veren önemli alanlardan birisidir. Etiğin konusu, iyi ve doğru gibi değerlere ilişkin kurallardır. Mesleklere ilgili iyi ve doğru gibi değerlere ilişkin kurallar da meslek etiği olarak adlandırılır. Bilim etiği, bilimin iyi ve doğru uygulamalarını konu edinen bir meslek etiğidir. Bilim etiği kurallarının devlet gücü ile uygulanır hale gelmesi durumunda, hukuk kurallarından söz edilebilecektir. Buna bilimsel araştırma ve yayın etiği de denilmektedir. Böylece bilim etiğinin hukuki rejimi ortaya çıkmış olacaktır. Bilim özgürlüğü Anayasada temel insan haklarından birisi olarak koruma altına alınmıştır. Bunun yanında akademisyenler ve üniversiteler için akademik özgürlük de Anayasada düzenlenmiştir. Bilim etiğinde birçok etik ihlal kuralları belirlenmiştir. İntihal bilim etiğinin temelini oluşturan en ağır etik ihlallerden birisidir. Yazarlık ve eserlerle ilgili olan bu durum Fikir ve Sanat Eserleri Kanununda yer almaktadır. İntihalin yanında başka bilim etiği ihlalleri de bulunmaktadır. Bunlar da Yükseköğretim Kanununda düzenlenmiştir. Bilim etiğinin ihlal edilmesi halinde cezai, hukuki ve idari yaptırımlar uygulanabilmektedir. İdari disiplin yaptırımların uygulanabilmesi için etik kurulların etik ihlal tespiti incelemesi yapması gerekmektedir.
Science is one of the important fields that guide humanity with scientific research and publications. The subject of ethics is the rules regarding values such as good and right. Rules regarding values such as good and right related to professions are also called professional ethics. Science ethics is a professional ethics that focuses on the good and correct practices of science. If the rules of science ethics become implemented by state power, they can be mentioned in the rules of law. This is also called scientific research and publication ethics. Thus, the legal regime of scientific ethics will emerge. Freedom of science is protected in the Constitution as one of the fundamental human rights. In addition, academic freedom for academics and universities is also regulated in the Constitution. Many ethical violation rules have been determined in science ethics. Plagiarism is one of the most serious ethical violations that forms the basis of scientific ethics. This situation, which is related to authorship and works, is included in the Code on Intellectual and Artistic Works. Besides plagiarism, there are other violations of scientific ethics. These are also regulated in the Higher Education Code. In case of violation of scientific ethics, criminal, legal and administrative sanctions may be applied. In order for administrative disciplinary sanctions to be imposed, ethics committees must conduct an ethical violation detection review.
