| dc.description.abstract | Günümüzde, özellikle sağlık, eğitim, turizm yatırımlarının gerçekleştirilmesi; büyük çaplı alt yapı projelerinin uygulamaya konulmasının özel hukuk kişileri tarafından yapılması, bir özel hukuk kurumu olan üst hakkına kamu malı olan taşınmazlar üzerinde de başvurulmasına sebep olmuştur. Kamuya ait taşınmazlar üzerinde kurulan üst hakkının taşıdığı işlevsel önem sebebiyle bu durum kamu hukukuna ilişkin kaynaklarda da yer almıştır. Bu nedenle, makalemizde kamu hukuku kaynaklarında üst hakkını da kapsayan irtifak hakları ile ilgili getirilen düzenlemeler ve bunların Medeni Kanun’da ki üst hakkı hükümleriyle olan ilişkisi ele alınacaktır. | en_US |
| dc.description.abstract | The fact that the investments particularly in health, education and tourism are made and the large-scale infrastructure projects are implemented by private legal persons has led to the fact that the right of construction, which is a private law institution, is also resorted for the public properties. Due to the functional significance of the right of construction, which is established on public properties, this situation is also included in the sources on the public law. Therefore, our article will address the regulations imposed on rights of easement that also involves the right of construction in the resources on public law as well as their relationship with the provisions of right of construction in the Civil Code. | en_US |
