| dc.description.abstract | Uluslararası ticarette, satıcı, sattığı ürünün ayıplı olması durumunda alıcıya karşı sorumludur. Alıcı ise, ayıplı mal ve ürünü gözden geçirerek mal / ürün hakkında satıcıya bildirim vermekle sorumludur. Bu çalışmada, satın alınan bir mal ve ürünü olası ayıplı çıkması durumunda, alıcının hangi haklara sahip olduğu uyuşmazlığın çözümünde hangi mevzuatın uygulanacağı konularına yer verilmiştir. Ayıplı mal satışında satıcı ve alıcının sorumlulukları ile ilgili olarak ulusal ve uluslararası hukuka yer verilmiştir. Uluslararası ticarette bir malın bir hizmetin, ayıplı olması durumunda tacirin sorumluluklarının neler olduğu bu araştırmanın problemini oluşturmaktadır. E ticaretin yaygınlık kazandığı günümüzde uluslararası ticaret yapan tacirlerin, alıcı ve tedarikçilerin sorumluluklarının haklarının neler olduğunu bilmesi, sosyal hayatta ticaretin tüm paydaşları açısından önem taşımaktadır. Bu araştırmada, 6098 Sayılı Türk Borçlar Kanunu, 6102 Sayılı Türk Ticaret Kanunu, 6502 sayılı Tüketicinin Korunması Hakkında Kanun (TKHK) ile Milletlerarası Mal Satımına İlişkin Sözleşmeler Hakkında Birleşmiş Milletler Anlaşması (CISG)’na göre ayıplı malda tacirin sorumlulukları incelenmiş, Avrupa Birliği Direktifleri ile Türkiye’de ulusal hukukta Yargıtay kararları ele alınmıştır. Araştırmada tarama modeli kullanılarak, geçmişte görülen hâlihazırda var olan bir durum, betimlenmeye çalışılmıştır. | dc.description.abstract | In international trade, the seller is responsible to the buyer if the product he sells is defective The buyer, on the other hand, is responsible for reviewing the defective goods and notifying the seller about the goods. In this study, in case a purchased good is found to be defective, the rights of the buyer and the legislation to be applied in the resolution of the dispute are included. National and international law are included regarding the responsibilities of the seller and the buyer in the sale of defective goods, in today's world where e-commerce has become widespread, it is important for all stakeholders of trade in social life to know what the responsibilities of traders, buyers and suppliers are and what their rights are. The problem of this research is what the responsibilities of the merchant are in case a good or a service is defective in international trade. In this research, the responsibilities of the merchant in the defective goods according to the Turkish Code of Obligations No. 6098, the Turkish Commercial Code No. 6102, the Law No. 6502 on the Protection of Consumers (TKHK) and the United Nations Agreement on Contracts for the International Sale of Goods (CISG). In the research, an attempt was made to describe an existing situation in the past by using the scanning model. Defective goods/services, which are the subject of the research, are defined in their own terms. | en_US |
