Özet
Mahkeme tarafından yargılama sonunda verilen hu?ku?m ile tarafların hak ve yu?ku?mlu?lu?kleri, özellikle varılan sonucun ne olduğu açıkça gösterilir. Kararın icrasında sorunlarla karşılaşılmaması adına hu?kmu?n tereddu?tte yol açmayacak biçimde açık ve anlaşılır olması beklenmektedir. Ancak hu?ku?mde bazı yazı ve hesap hataları olabileceği gibi hu?ku?m yeterince açık olmayabilir veya birbiri ile çelişik fıkralar içerebilir. Bu durum genellikle hu?kmu?n (ilamın) icrası aşamasında (İİK m. 24 vd.) anlaşılır. Ancak mahkeme, hu?kmu?nu? vermekle (hu?kmu? imzalamakla) dosyadan elini çekmiş olur. Bundan sonra hu?ku?mde herhangi bir değişiklik yapamaz. Mahkemenin dosyaya yeniden el atabilmesi, ancak kanun yolları sonucunda u?st mahkemenin, dosyayı kararı veren mahkemeye göndermesine bağlıdır. Bu kuralın istinası olarak 6100 sayılı HMK'nın Beşinci Kısım İkinci Bölu?mu?nde "Hu?kmu?n Tashihi, Tavzihi ve Tamamlanması" du?zenlenmiştir. Söz konusu du?zenlemeler ile amaçlanan kararı veren mahkemeden hu?ku?mdeki maddî hatayı du?zeltmesi, çelişkiyi veya tereddu?ttu? açıklığa kavuşturması, talep edilmesine veya mahkemece re'sen hu?kme geçirilmesi gerekli olmasına rağmen hakkında karar verilmeyen hususlarda ek karar verilmesini mu?mku?n kılmaktır.
Per judgement to be given by the court at the end of the trial, it clearly shows the rights and obligations of the parties, especially how clear the reached result is. In order not to encounter problems during the implementation of the verdict, it is expected that it will be clear and understandable without causing any ambiguity. However, some and calculation errors may have been made in the verdict, as well as the provision may not be clear enough or contain contradictory clauses. Such situation is generally understood during the execution of the verdict. However, the court recedes by giving the verdict (signing the verdict) and cannot make any changes in the verdict after that. The court's capacity to take over the case again depends on the higher court sending the file to the court that made the decision. As an exemption to this rule, "correction, clarification and completion of the verdict" is regulated in the second part of the fifth part of the HMK numbered 6100. Because of the said regulations it is possible for the court that made the targeted decision to correct the material error in the verdict, to clarify the contradiction or ambiguity, to make additional decisions on matters that have not been decided although it is required to be requested or to be given ex officio by the court.
