dc.description.abstractBu çalışmada eğitim hakkı, Uluslararası hukuk ve Türk Hukukundaki düzenlemeler çerçevesinde incelenmiştir. Eğitim ve eğitim hakkı kavramlarının ne anlama geldiği ifade edilmiş, daha sonra uluslararası düzenlemelerde ve özellikle Birleşmiş Milletler İnsan Hakları Evrensel Bildirisi (madde 26), Avrupa İnsan Hakları Sözleşmesi ile Avrupa İnsan Hakları Sözleşmesi'ne Ek 1. Protokol'ün 2. maddesi ve Ekonomik, Sosyal ve Kültürel Haklara İlişkin Uluslararası Sözleşme (madde 13 ve 14) kapsamına eğitim hakkının ne şekilde düzenlendiği ve sınırları incelenmiştir. Sonrasında, Türkiye Cumhuriyeti Anayasası'nda eğitim hakkı anlatılmaya çalışılmıştır. Bu tezin amacı rluslararası hukukta, Türk hukukunda eğitim hakkının içeriğini ve devletlerin ilgili ödevlerini açıklamaktır. Birleşmiş Milletler Örgütü tarafından kabul edilen uluslararası sözleşmeler ile Birleşmiş Milletler (BM) uzmanlık örgütlerinin ortaya koyduğu belge ve çalışmalarda eğitim hakkının, haklarını kullanma yönünden dezavantajlı kabul edilen kişi ve gruplara özgü içerik ve anlamı da belirlenmiş engellilerin, azınlıkların, çocukların eğitim hakkı, insan hakları belgelerinin konusu olmuştur.en_US
dc.description.abstractIn this study, the right to education, in the framework of the International law and Turkish Law and regulations have been investigated. The right to education and training concepts expressed what it meant subsequently, In international regulations and in particular the United Nations Universal Declaration of Human Rights (Article 26), United NationsChild Rights Convention, European Convention on Human Rights and in the scope of the European Convention on Human Rights First Protocol Additional to the second and the International Covenant on Economic, Social and Cultural Rights (Article 13 and 14) item the right to education is organized in what way and it's limits were examined is then, Right to education in the Constitution of the Republic of Turkey. This thesis aims at clarifying the contents of the right to education in the International law, Turkish Law and the corresponding obligations of the government. Educational right in international agreements accepted by United Nation and documents and studies introduced by United Nations Specialized Commissions designated the meaning and content peculiar to disadvantaged groups or people in using their rights and the right to education of disabledpeople, minority, children became the subject of international documents.en_US
