Özet
Bu çalışmada, idari işlem olan kamulaştırmanın uzlaşma yolu ile mi yoksa dava yolu ile mi yapılmasının vatandaş ve idare açısından avantaj ve dezavantajlarının (süre, bedel, …vs) ortaya konulmasının incelenmesi için; kamulaştırmaya genel bir bakış, tarihsel değişimi incelemesi ve Mahkeme dosyalarından 5 yıl (2013-2017) zaman aralığında bir mahkemeye düşen dosya sayısı konusu ile dosya irdelemeleri yapılarak istatistiksel verilere ve sonuçlara ulaşılmaya çalışılmıştır.
In this study, in order to examine the advantages and disadvantages of the administrative process, whether through expropriation or through litigation, and its advantages and disadvantages for citizens and administrations (time, cost, etc.); An overview of expropriation, review of historical evolution, and the number of files pertaining to a court in the period of 5 years (2013-2017) from the court files were examined and the data and the results were analyzed.
