Özet
Bu çalışmada, kamu yatırımlarına yakınlığı ve hazine arazilerinin varlığı sebebiyle gecekondu işgaline maruz kalan alanlarda, mülkiyet kavramının kentsel dönüşüm odaklı gayrimenkul geliştirme süreçlerindeki belirleyici etkisi ortaya konulmaktadır. Bu amaçla, çalışma kapsamında, mülkiyet kavramı ve kentsel dönüşümün yasal çerçevesi tanımlanmış, İstanbul İli, Maltepe İlçesi, Başıbüyük ve Gülsuyu mahallelerinde bulunan, varsayımsal olarak (A) ve (B) şeklinde adlandırılan proje alanlarında yapılmış uygulamalar özelinde mülkiyet ve yasal altyapı kavramlarının kentsel dönüşüm sürecine etkileri detaylı olarak analiz edilmiştir.
In this study, the determinative effect of ownership structure on the urban transformation-oriented real estate development process is revealed on slums exposed to the occupation due to the proximity to public investments and the existence of treasury land. For this purpose, the concept of ownership and the legal frame of urban transformation are defined. Within the scope of the study, the impacts of ownership and legal infrastructure concepts on urban transformation process have been analyzed in detail by in the field of project areas hypothesizing as (A) and (B), located in the neighborhoods of Başıbüyük and Gülsuyu of Maltepe district in İstanbul.
