| dc.description.abstract | Temel haklar birey haklarıdırlar. Devleti yükümlendirirler ve ondan haklı çıkarılma (meşruluk) isterler. Bu nedenle devletten önce gelirler. Temel haklar, bireyin devletten yana kısmen bağımlılıktan kurtulması ve devlet karşısında güvence altına alınması ile sınırlı kalmayıp, devlete bağlayıcı bir bağ ve siyasal anlaşmanın temeli olarak görülmelidirler. Çeşitli bakış açılarından temel hakların türleri ve fonksiyonları konusunda tipleştirmeler yapılabilir. Bütün temel haklarda ortak olan bireyin özgürlüğüne ilişkin olmalarıdır. Değişik temel haklarda farklı olan, bireyin özgürlüğü için üstlendikleri fonksiyonlardır. Şekil verdikleri ve garanti ettikleri statüye göre saldırılara karşı koyma, ortaklık ve edimde bulunulmasını isteme, yönetime katılma yoluyla özgürlüğü garantilerler. | en_US |
| dc.description.abstract | Fundamental rights are individual rights. They oblige the state and demand justification (legitimacy) from it. Therefore, they come before the state. Fundamental rights should not be limited to the individual being partially freed from dependence on the state and secured against the state, but should be seen as a binding bond to the state and the basis of political agreement. Typicalizations can be made about the types and functions of fundamental rights from various perspectives. Common to all fundamental rights is that they relate to the freedom of the individual. What differs in different fundamental rights is the functions they undertake for the freedom of the individual. According to the status they shape and guarantee, they guarantee freedom by resisting attacks, asking for partnership and action, participating in the administration. | |
