Abstract
Hasarın İntikali meselesi satım sözleşmeleri bakımından büyük önem arz etmektedir. İş bu konu Roma Hukuku’ndan beri, tartışmalara konu olmuş bir nitelik taşımasıyla birlikte, İsviçre Hukukunda ve diğer yabancı hukuklarda da ele alınmış ve birçok monografiye konu edilmiştir. Özellikle günümüz de uluslararası satışlarda ülkeler arasında ki farklı hukuki düzenlemeler nedeniyle problem oluşturmaya en uygun hukuki konulardan biri olmuştur. Bu çalışmanın amacı içeriğinde bir çok problemi barındıran hasarın geçişi meselesinin, Türk Hukuk siteminde kendine yer bulmuş olan 818 sayılı Borçlar Kanunu, 6098 sayılı Türk Borçlar Kanunu kapsamında ve bir çok boşluğu doldurmak amacıyla hazırlanan ve Türkiye’nin de 2010 yılında taraf olduğu 1980 tarihli Malların Uluslararası Satışı Hakkındaki Viyana Konvansiyonu ve sözleşme serbestisi çerçevesinde en çok kullanılan standart sözleşme şartları ICC tarafından hazırlanan ve yıllar içerisinde yenilenen INCOTERMS 2010 kuralları açısından incelenmesidir.
Transfer of Damages Liability is highly important for selling agreements. Debates on this matter date back to Roman Law and it has been discussed in Switzerland Law and other foreign laws and it constituted subject matter of many monographs. Particularly in the present day, it is one of the legal matters that poses high risk of challenges in international sales due to different legislative regulation between countries. Objective of the present study is to analyse the transfer of damages involving numerous problems, with respect to INCOTERMS 2010 rules prepared by ICC (International Chamber of Commerce) and revised in years that are the most frequently used standard agreement conditions in accordance with the freedom of contract, within the framework of Obligations Code No. 818 that was implemented as a part of Turkish Legal System, Turkish Obligations Code No. 6098 and 1980 Vienna Convention on International Sale of Goods that was prepared for the purpose of filling several gaps and adopted in 2010 by Turkey.
