Özet
H.1262/1846-47 tarihinde, Sultan Abdülmecid döneminde, Fethi Ahmed Paşa tarafından Aya İrini kilisesi içinde toplanan Eski Silahlar ve Eski Eserler, bir süre sonra bu koleksiyonun müze olarak hayat bulmasını sağlayacaktır. Taşınır eski eserlerin bir koleksiyon olacak şekilde bilimsel usullerle toplanması ve teşhire açılması, günümüzde korunması taşınmaz kültür varlığı olarak ifade edilen taşınmaz eski eserlerin korunması için bazı yasal düzenlemelere ihtiyaç duyulmasına yol açar. İlk olarak 9 Ağustos 1858 tarihli Ceza Kanunnamesine konulan bir hüküm ile koruma altına alınmaya çalışılan kültür varlıkları ile ilgili yasal mevzuatın gelişmesi ve günümüzdeki durumu hakkında bir değerlendirme.
