Kamulaştırma kamu yararı gerekçesi ve bedeli peşin ödenmek koşulu ile kanun gücüyle mülkiyetin el değiştirmesine olanak sağlayan bir zorla alım yöntemi olduğundan Belediyelerin hem bütçeleri açısından hem de mülkiyeti elinden alınan yerel seçmenleri açısından önemli zorluklar içermektedir. Bu çalışma kapsamında Belediyelerde gerçekleştirilen kamulaştırma işlemlerine dair yaygın olarak yaşanan problemler farklı yönleriyle araştırılmış ve analiz edilmiştir. Analizlere göre elde edilen bulgular kamulaştırma sürecindeki tüm bileşenler dikkate alınarak değerlendirilmiştir. Çalışmanın sonunda yapılacak kamu yatırımlarında ortaya çıkan mülkiyet sorunlarının çözümü hakkında hem Yerel Yönetimler açısından hem de mülkiyeti elinden alınan hak sahipleri açısından sürdürülebilir çözüm önerileri ortaya konmuştur.In this study; The problems related to the expropriation works and transactions realized for the solution of the property problems, which is one of the biggest problems that come before them in the investments to be made by the municipalities, and the suggestions for the solution of these problems are examined. Expropriation is a method of forced procurement, which allows for the change of ownership of property by law with the public interest justification and the cost of payment in advance. Within the scope of this study, the problems encountered in the expropriation processes carried out in the municipalities were investigated and analyzed in different aspects. The findings obtained from the analyzes were evaluated considering all the components of the expropriation process.
