Bugün Dünyada temel haklar ve özgürlüklerin garantisinin çok büyük bir önem taşımasına karşın temel hak taşıyıcısının temel hak ve özgürlükleri denetimsiz ve aşırı kullanması, kamu yararıyla ve diğer temel hak sahiplerinin haklarıyla çatışabilir. Bu nedenle, temel hakların kullanımına sınırlar çizilmektedir. Anayasa koyucu temel haklar için sınırlamalar öngördüğünde, bireyin özgürlük isteği ile devlet içindeki toplumsal yaşamın gerekleri arasında doğal olarak gergin bir ilişki ortaya çıkacaktır. Bu gerekler, başka temel hak taşıyıcılarının özgürlük alanlarına saygı gösterilmesi ve devletin menfaatlerinin ve hukuksal değerlerinin korunmasıdır. Burada ölçülülük ilkesi devreye girecektir.Human rights had existed before the formation of the State. They are called as “fundamental rights”, when they are guaranteed by the State. Although today the guarantee of fundamental rights and freedoms is very crucial worldwide, the use of fundamental rights and freedoms by its owner without control might conflict with public interest and the rights of the other owners of fundamental rights. Therefore, there are restrictions on the use of fundamental rights. When the legislator suggests restrictions for fundamental rights, the relationship between individual’s desire for freedom and the necessities of social life in a state will naturally be strained. These necessities are the respect for freedoms of the other owners of fundamental rights and the protection of the interests of state and juridical values.
