Burada temel mantık; özel mülkiyetin belirlendiği hakların korunması ve kamu yararı arasındaki bağlantının ilişkilendirilmesidir. Günümüzde, İmar planlarına işlenen donatı alanları, uygulama araçlarının kısıtlı olması sebebiyle kamu yararı adına kullanılamadığından mülkiyet hakkı kısıtlanmakta ve kamu yararı gerçekleştirilememektedir. Bu çalışmada maliklerin hak kayıplarının telafi edilmesi için İmar Hakkı Transfer (İHT) ile imar uygulama alanları belirtilerek Türkiye’de İHT sisteminin geliştirilmesi amaçlanmaktadır.Development rights are one of the many rights comprising by the concept of private property. The primary goal here is the protection of private property rights and associating to the connection between the public interest. At the present time, based upon the failure to use the reinforcement areas booked in the development plans for the public weal due to the limited number of implementation tools, the property right is restricted and the public interest cannot be accomplished.
