Devlet, yasama ve yargı yoluyla zayıfları baskıya karşı korumak ve toplumsal gücün her türlü kötüye kullanımına karşı savaşmak zorundadır. Şu halde Devlet toplumda da gerçek anlamda eşit özgürlüğü gerçekleştirmekle yükümlüdür. Şematik bir eşitleme değil, objektif, sosyal eşitleyici bir ayırım anlamında diferansiyel bir adalet amaçlanmalıdır. Herkese aynını değil, herkese kendisine düşeni vermelidir: (Suum-cuique: herkese kendisininki). Kendi adalet tasarılarını gerçekleştirmek ve Devletin sosyal düzenlemelerinin yönü konusunda karar vermek, öncelikle yasa koyucunun işidir. Ancak bunu yaparken keyfi davranmamak zorundadır.Principle of Equality, as all other fundamental rights, is oriented to the relation of the State to the owner of fundamental rights.The State has to protect the poor people against influence via legislation and jurisdiction and has to battle with the abuse of the social force. Namely, the State is obliged to realize equal freedom in the public in the real sense.Not a schematic equality but objective, social justice securing equality must be aimed. Everyone should not be given the same, but should be given his/her due (Suum-cuique: to each his/her own). Realizing its own justice plans and determining the direction of social regulations are primary duties of the legislator.
